Please read these terms and conditions carefully. These are the terms that will govern any contract between you and us for the sale of the products on this website.

All designs, text, products and imagery on www.merpots.co.uk are the copyright of Mermaid Enterprises. This site, or any part of it, may not be republished in any way without express permission from Mermaid Enterprises.

Mermaid Enterprises customers who shop online must be 18 years or over.

Your statutory rights are not affected by anything in these terms.

If it becomes necessary for a court to enforce these terms and conditions and any of these terms is found to be invalid, void or unenforceable, this will not effect the remainder of these terms, which shall remain in full force and effect.

These Terms and Conditions shall be governed in all respects by, and in accordance with, current English Law, and you accept the non-exclusive jurisdiction of the English Courts.

Making A Purchase Making a purchase could not be easier. Just browse our Shop, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Checkout" and you will be asked for a few details that we need to be able to satisfy the order.

We do not charge for any stocked items until they are ready for shipping. For custom "bespoke" items, we charge 50% (non-refundable) on final confirmation of order and the final 50% when the order is ready for shipping.

We can at present only accept orders by cheque (made payable to 'Melanie Arbib'). We will not ship the products until the cheque has cleared.

Please note that it is your responsibility to check that your order is accurate and to supply all relevant information necessary to complete the order on request.

We cannot accept liability to the fullest extent permitted by law for any damages or loss of any kind arising out of or in connection with the use of this website.

Shipping And Handling When ordering, please select the method of shipping that you prefer. We are based in Milton Keynes, Buckinghamshire, UK for those who wish to collect their order. If you have any questions concerning delivery please email us: shipping@merpots.co.uk

The ownership of goods supplied by us shall not pass to you until payment in full has been made to us by you.

Damaged Goods and Non-Delivery Claims: In the event of such, both we and our carriers must be notified within the following time scales:

- Non delivery of goods: 21 days from date of despatch.

- Damages and/or shortages: 7 days from date of receipt. Outer packaging and damaged goods must be retained for inspection by carriers.

By doing this, you better enable us to deal efficiently with your claim.

Delivery of wrong or out of specification goods: If on delivery, goods are found to be thus, then we must be notified in writing (email, fax, letter) within 7 days of the delivery date, otherwise no liability will be accepted. In the event that we require return of the goods, then we reserve the right to specify the method of return.

Delivery Goods will usually be shipped via the customer's chosen means:

- within one working day for items available from stock

- within 7 to 30 days from final order confirmation for custom or commissioned work, depending on quantity and complexity. Orders needing longer will only be taken with your consent.

In the event of delays to your original delivery date, we can either reschedule, or you may cancel the order.

If you're having greeting cards sent to yourself for signing and sending, please make sure you allow yourself enough time to receive the cards before sending them on.

Urgent Orders: If your order is requires faster than normal lead times, we will of course endeavour to meet your schedule where possible. Please place your order and we will be in touch.

We will take all reasonable steps to ensure safe delivery of our goods. Risk of damage remains with us until delivery takes place. If you have any problems in this respect please contact us by email

Please note that 'What date would you like your order for' is merely a preference given at order time. There can be no assumption made that we will be able to deliver your order by that time.

Returns and Cancellation You may cancel in writing (letter, fax, email) any order for stock products up to 7 days after receipt of your goods. After notifying us of such, you must keep what are then our goods in new condition, and return them to us as soon as possible at your expense. You will receive as soon as possible full refund for the order; certainly within 30 days after your written cancellation notice.

We regret that we cannot accept cancellations for custom or commissioned work. In event of cancellation prior to delivery, the 50% up front fee will not be refunded. Note that such work includes any personalisations.

Mermaid Enterprises reserves the right to revise prices, availability and details at any time without notice, and orders are only accepted on the understanding that the prices charged are those current at the time of receipt of order.

We will confirm acceptance of your order by e-mail as soon as possible; but before we do so you should not assume that we have accepted your order, and no contract will subsist between us. Our acceptance will be effectively communicated to you at the time that we send the e-mail to you (whether or not you receive it).

Tax Charges All products and prices, regardless of where they are shipped, include UK VAT.

Guarantees We are not a 'replica' or 're-production' pottery; all our items are characteristically unique, and thus our items will have individual differences and variances, in size, colour and shape. Colour Accuracy on the Website cannot be guaranteed, and will vary depending on the resolution and screen type of your computer. There is also a normal natural variance in colour of ceramics due to firing and a natural variation in raw materials.

We recommend that no earthenware is ever dishwashed or left submerged in water due to its inherent porous nature. We cannot guarantee our stoneware products to be long-term dishwasher safe; but merely suggest that you treat them as you would your best china.

Force Majeure: We are not liable for any failure or delay in complying with any obligation under these terms and conditions caused by: acts of God, civil unrest, riots, floods, drought, fire, power cuts, and legislation.

We have made every effort to ensure we only link to reputable sites; however, being not under our control, we cannot accept responsibility for them. Nor can we accept any liability for the content, accuracy, or availability of any information that is accessible via this website.
